Please read and agree to the Home Banking Access Agreement to proceed

I. Introduction

This Online Access Agreement ("Access Agreement") for accessing your First Bristol Federal Credit Union accounts through Home Banking explains the terms and conditions governing the Online banking services offered through Home Banking. By using the Home Banking Services, you agree to the terms and conditions of this Access Agreement. This Online Access Agreement will be governed by and interpreted in accordance with Federal law and regulation, and to the extent there is no applicable Federal law or regulation, by the laws of the State of Connecticut. The terms "we," "us," "our," "First Bristol Federal Credit Union," and "Credit Union" refer to First Bristol Federal Credit Union.. "You" refers to each signer on an account. The term "business days" means our business days. Our business days are Monday, Tuesday, Wednesday from 9:00am to 4:30pm; Thursday from 9:00am to 5:30 pm; and Friday from 9:00am to 4:30pm. Saturday, Sunday and Federal holidays are not included as a business day. (If you contact us outside of our normal business hours, we may consider your communication as having been made during the business immediately following the day you actually contacted us.)

Home Banking can be used to access First Bristol Federal Credit Union accounts. Each of your accounts at First Bristol Federal Credit Union is also governed by the applicable account disclosure statement ("Membership and Account Agreement ").

II. Accessing Your First Bristol Federal Credit Union Accounts through Home Banking

A. Requirements

To access your accounts through Home Banking, you must have a First Bristol Federal Credit Union account in good standing, be older than 18, have a sign on ID and have an online password.

A business must be operating under a tax payer identification number which must be the owner's Social Security Number to have access to these accounts.

B. Electronic Mail (E-mail)

Sending electronic mail (E-mail) through Home Banking is a way to communicate with the Credit Union. E-mail is provided for you to ask questions about your account(s) and provide general feedback. E-mail is accessible after you sign on with your password to a session of Home Banking. To ensure the security of your account information, we recommend that you use E-mail when asking specific questions about your account(s).

You cannot use E-mail to initiate transactions on your account(s). You must use the appropriate functions within Home Banking or call 860-584-0956.

C. Fees

There are no monthly or transaction fees for accessing your account(s) through Home Banking.

Please note that fees may be assessed by your Online service provider.

D. New Services

First Bristol Federal Credit Union may, from time to time, introduce new Online services. We will notify you of any new services. By using these services when they become available, you agree to be bound by the rules communicated to you concerning these services.

E. Benefits of Using Home Banking

With Home Banking, you can manage your personal or small “doing business as” accounts from your home or office on your personal computer. You can use Home Banking to:

  • View account balances and review transaction history.

  • Transfer money between your accounts. (As noted in the applicable account Deposit Agreement and Disclosure Statement).

  • Communicate directly with First Bristol Federal Credit Union through E-mail.

III. Terms and Conditions

The first time you access your First Bristol Federal Credit Union accounts through Home Banking you agree to be bound by all the terms and conditions of this Agreement and acknowledges your receipt and understanding of this disclosure.

A. Your Online Password

You will be given an Online Password that will give you access to your First Bristol Federal Credit Union accounts for Home Banking access. This password can be changed within Home Banking using the options button. We recommend that you change your password regularly. First Bristol Federal Credit Union will act on instructions received under your password. For security purposes, it is recommended that you memorize this Online password and do not write it down. You are responsible for keeping your password, account numbers and other account data confidential. You agree you will not give your online password to anyone who is not allowed to transact business on your account(s). In the event that you do give your online password to another person you will be responsible for all transactions done by that person, just as if you had made the transactions yourself. If you forget you online password, you must notify the Credit Union before you will be able to access your accounts again.

B. Our Liability

Except as specifically provided in this Agreement or where the law requires a different standard, you agree that neither we nor the service providers shall be responsible for any loss, property damage or bodily injury, whether caused by the equipment, software, First Bristol Federal Credit Union, OR by Internet browser providers, OR by Internet access providers, OR by Online service providers, OR by an agent or subcontractor of any of the foregoing. Nor shall we or the service providers be responsible for any direct, indirect, special or consequential, economic or other damages arising in any way out of the installation, use or maintenance of the equipment, software, the Online Financial Services, or Internet browser or access software.

C. Overdrafts: Order of Payments, Transfers, Other Withdrawals

If your account has insufficient funds to perform all electronic funds transfers (ATM withdrawals, pre-authorized transactions and Home Banking transfers, etc.) that you have requested for a given business day, then:

  • 1.      Certain electronic funds transfers involving currency disbursement, like ATM withdrawals, will have priority, and
  • 2.      The electronic funds transfers initiated through Home Banking may result in an overdraft of your account and may, at First Bristol Federal Credit Union's discretion, be canceled.

In addition, you will be charged the same overdraft charges that apply to your account.

D. Hours of Accessibility

You can access your First Bristol Federal Credit Union accounts through Home Banking seven days a week, 24 hours a day. However, at certain times, some or all of Home Banking may not be available due to system maintenance. You will be notified Online when this occurs.

IV. General Terms

A. Changes to Charges, Fees or Other Terms

We reserve the right to change the charges, fees or other terms described in this Agreement. However, when changes are made to any fees or charges, we will notify you Online, or send a notice to you at the address shown on our records, or send you an electronic mail message (E-mail). The notice will be posted or sent at least thirty (30) days in advance of the effective date of any additional fees for Online transactions, or of any stricter limits on the type, amount or frequency of transactions or any increase in your responsibility for unauthorized transactions, unless an immediate change is necessary to maintain the security of the system. If such a change is made, and it can be disclosed without jeopardizing the security of the system, we will provide you with electronic or written notice within thirty (30) days after the change. As always, you may choose to accept or decline changes by continuing or discontinuing the accounts or services to which these changes relate. We also reserve the option, in our business judgment, to waive, reduce or reverse charges or fees in individual situations. Changes to fees applicable to specific accounts are governed by the applicable Membership and Account Agreement

Batch Processing is conducted each day at 6:30pm. A transfer initiated through Home Banking before batch processing has completed will have a posting date effective that day. A transfer initiated after batch processing has completed on a business day or on a Saturday, Sunday or Credit Union Holiday will have a posting date effective the next business day.

E. Additional Terms and Conditions

Transferring Funds - The number of transfers from a savings account is limited as described in the applicable Membership and Account Agreement. If a hold has been placed on deposits made to an account from which you wish to transfer funds, you cannot transfer the portion of the funds held until the hold expires.

B. Disclosure of Account Information

You understand that in addition to information furnished pursuant to legal process, some information about your accounts may automatically be disclosed to others. For example, the tax laws require disclosure to the government of the amount of the interest you earn, and some transactions, such as certain large currency and foreign transactions, must be reported to the government. The Credit Union may also provide information about your account(s) to third parties when any of the below listed conditions exist.

  • It is necessary for completing transactions or for collecting a check or share draft.
  • It is needed to verify the existence or condition of your account for a third party, such as a credit bureau.
  • We must comply with a government agency request, or court order or subpoena.
  • You give us your written permission.
  • Your account and/or transfers involve a claim by or against us on an item deposited to or drawn against your account.
  • In order to tell a third party who has one of your share drafts whether we would be able to pay that share draft if that person gave it to us at that time for payment.
  • You owe us money and we go to court to collect it.
  • We ask an attorney or collection agency to collect money that you owe us.
  • Our accountants or auditors need information about your account or your transactions as part of their review of our business affairs.
  • We may disclose information which does not identify you or your account.
  • To government officials in connection with suspected violations of criminal law.
  • We may also have other reasons for disclosing information to third parties about your account(s) or transfers that you make.

 In addition, the Credit Union routinely informs a credit bureau when accounts are closed by the Credit Union because they were not handled properly. The Credit Union may also seek information about you from others, such as a credit bureau, in connection with the opening or maintaining of your account. You authorize these transfers of information.

C. Your Right To Receive Documentation of Transactions

All transactions performed on your account(s) using Home Banking will be recorded on your periodic statement. You will receive a statement monthly unless there are no transactions on the account (through any means) in a particular month. In any case, you will receive a statement at least quarterly.

D. Questions or Error Corrections on Home Banking Transactions

In case of questions or errors about transfers through Home Banking involving your account, here is what you should do:

  • Contact First Bristol Federal Credit Union by electronic mail (E-mail)
  • Fax First Bristol Federal Credit Union at 860-583-0743 or telephone First Bristol Federal Credit Union at 860-584-0956 during the following business hours:

-9:00am – 4:30pm Monday, Tuesday, Wednesday or

-9:00am – 5:30pm Thursday or

-9:00am – 4:30pm Friday.

Write First Bristol Federal Credit Union at 25 North St./P.O. Box 698, Bristol CT 06011-0698, as soon as you can if you think your statement or transaction record is wrong, or if you need more information about a transaction listed on the statement or transaction record

We must hear from you no later than sixty (60) days after we have sent the first paper statement on which the problem or error appeared. If you notify us verbally, we may require that you send us your complaint or question in writing within ten (IO) business days.

Tell us your name and account number

Describe the error or the transaction you are unsure about, and explain why you believe it is in error or why you need more information.

Tell us the dollar amount of the suspected error.

Here's what we will do:

We will tell you the results of our investigation within ten (10) business days, or twenty (20) business days in the case of point of sale purchases, after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days, or ninety (90) days in the case of point of sale or international transactions, to investigate your complaint or question. If we decide to do this, we will credit your account within ten (10) business days, or twenty (20) business days in the case of point of sale or international transactions, for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we will not credit your account. If we determine that there was no error, we will send you a written explanation within three (3) business days after we finish our investigation and debit the amount of the error that we previously credited. You may request copies of the documents that we used in our investigation.

If we do not complete a transfer to or from your First Bristol Federal Credit Union account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

  • If, through no fault of ours, you do not have enough money in your account to make a transfer. 

  • If a legal order directs us to prohibit withdrawals from the account. 

  • If your account is closed or if it has been frozen. 

  • If the transfer would cause your balance to go over the credit limit for any credit arrangement set up to cover overdrafts. 

  • If you, or anyone you allow, commits any fraud or violates any law or regulation.  

  • If any electronic terminal, telecommunication device or any part of the electronic fund transfer system is not working properly.  

  • If the transaction is prevented by policies, rules, or limitations imposed from time to time, such as minimum balance requirements or verification and collection of deposits.

  •  If you have not properly followed the instructions for using Home Banking. 

  • If circumstances beyond our control (such as fire, flood or improper transmission or handling of payments by a third party) prevent the transfer, despite reasonable precautions taken by us. 

  • A direct deposit/payroll deduction was not sent to us.

  • If it is the result of your willful or negligent use of your online password or any EFT facility for making such transfers.

  • If the fault is yours.

  • If other statements in this Agreement state so.

  • You do not give your correct online password or other identifying information.

  • Your Home Banking access has been cancelled or deactivated.

There may be other reasons under federal or state law why we will not be liable.

E. Other Agreements

Other Agreements - In addition to this Agreement you agree to be bound by and will comply with the requirements of the applicable Membership and Account Agreement, the Credit Union's rules and regulations, the rules and regulations of any funds transfer system to which the Credit Union belongs, and applicable State and Federal laws and regulations. We agree to be bound by them also.

F.  Joint Accounts

If the account is a joint account, the following applies:

1. All obligations and charges that apply to you under this Agreement and under any other agreement relating to the account also apply to all other owners of the account.  Each owner of the account is jointly and severally liable for the use of the account and for all withdrawals from the account.

2. Any one of you can give us written permission to disclose information about the account or transfers to third parties.

3. Any one of you can ask us to cancel Home Banking  access to your account(s).

G. Stop Payment Rights (Preauthorized Debit)

If you have arranged in advance to make regular EFT out of your account(s) for money you owe others, you may stop payment of preauthorized transfers from your account.  You must notify the Credit Union orally or in writing at any time up to three (3) business days before the scheduled date of the transfer.  The Credit Union may require written confirmation of the stop payment order to be made within fourteen (14) days of any oral notification.  If we do not receive the written confirmation, the oral stop payment order shall cease to be binding fourteen (14) days after it has been made.

H. Notice Of Varying Amounts (Preauthorized Debit)

If these regular payments may vary in amount, the person you are going to pay is required to tell you ten (10) days before each payment when it will be made and how much it will be.  You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment or when the amount would fall outside certain limits that you set.

I. Non-Enforcement Of Our Rights.

We can choose not to enforce or to delay in enforcing any of our rights under this Agreement or as allowed by law without losing any of our rights in the future.

J. Canceling This Agreement.

First Bristol Federal Credit Union Reserves the Right to terminate this Agreement - The Credit Union reserves the right to terminate this Agreement and your access to Home Banking, in whole or in part, at any time without prior notice.

If more than one person is authorized to conduct transactions from your account using Home Banking, we cannot stop that person from making those transactions from your account unless we terminate this Agreement or cancel this Home Banking that allows access to your account.

If the account is a joint account, any one of the account owners may ask us to terminate the Agreement, or cancel Home Banking service that allows access to your account.  Any one of the account owners may ask us to take any other action in connection with the account.  We can do this without prior or subsequent notice to or approval by the other account owner.

You can cancel this Agreement by asking us to cancel.    You can also cancel this Agreement by closing your account at the Credit Union or by removing home banking access to your accounts through the edit function in Home Banking.  You agree to give us 3 business days to cancel this Agreement after you give us notice.  You remain responsible for all transactions on your account(s) during these 3 business days.

Even if this Agreement is canceled, or ends, you understand that you will continue to be responsible for paying us whatever you owe us at that time under this Agreement.

K. Evidence Of Transactions.

You agree that a photographic record or copy of any transaction involving your account shall be evidence establishing your liability in any legal action involving you and us.

L. Applicable Law.

You agree that, except in the case where Federal law specifically applies, Connecticut law shall govern this Agreement.

V. Protecting Your Account

A. Preventing Misuse of Your Account

Your role is extremely important in the prevention of any wrongful use of your account. You must promptly examine your statement upon receipt. If you find that your records and ours disagree, you must immediately call First Bristol Federal Credit Union Customer Service at 860-584-0956.

Protecting Personal Information - In addition to protecting your account information, you should also take precautions to protect your personal identification information, such as your driver's license, Social Security Number, etc. This information by itself or together with information on your account may allow unauthorized access to your account(s). It is your responsibility to protect personal information with the same level of care that you protect your account information.

Taking Care of Your Online Password - The password that is used to gain access to Home Banking should also be kept confidential. For your protection we recommend that you change your Online password regularly. It is recommended that you memorize this Online password and do not write it down. You are responsible for keeping your password, account numbers and other account data confidential.

B. Unauthorized Transactions in Your First Bristol Federal Credit Union Accounts

Notify us immediately if you believe another person has improperly obtained your Online password. Also notify us if someone has transferred or may transfer money from your account without your permission, or if you suspect any fraudulent activity on your account. Only reveal your account number to a legitimate entity for a purpose you authorize (such as your insurance company for automatic payments). To notify us,

If you telephone us, we may ask you to confirm the information in your telephone call to us in writing within ten (10) business days.

If your Online password has been compromised and you tell us within two (2) business days after you learn of the loss or theft, you can lose no more than $50 if someone used your Online password without your permission to access a First Bristol Federal Credit Union deposit account. If you do NOT tell us within two (2) business days after you learn of the loss or theft, and we could have stopped someone from taking money without your permission had you told us, you could lose as much as $500.

If your statement shows withdrawals, transfers or purchases that you did not make or authorize, please notify us immediately. If you do notify us within (60) days after the paper statement was mailed to you, and we could have stopped someone form taking money if you had told us in time, you may not get back any money lost after the (60) days. If extenuating circumstances, such as a long trip or hospital stay, kept you from telling us, the time periods in this section will be extended.
